Beginning July 1, 2012, individuals who were previously convicted of certain non-violent, non-sexual misdemeanors and class E felonies may be eligible to have their convictions expunged pursuant to T.C.A. 40-32-101(g). To the left you will find a link to an information packet that sets forth all of the documentation that must be obtained prior to filing a petition to expunge a conviction, along with a checklist to aide you in the process. Click on the file "Expungement Information Packet" and download the packet to your computer. If after reviewing these materials you believe that you are eligible to have your conviction expunged, print and complete the forms, obtain copies of all required documents and bring all of these materials back to our office in Blountville.
We will review the materials that you provide to us and will notify you within sixty (60) days whether you meet all of the requirements to file a petition. If you are eligible, we will set up a time for you to come back to our office to sign the petition and file it with the Clerk’s Office. At that time you will need to have the $350 filing fee along with any other administrative fees imposed by the Clerk’s office.
Once the petition is filed with the Clerk’s Office they will assign a case number and docket it for a date to appear before a Criminal Court judge who will hear the petition and decide whether to grant your expungement.
